OpenAI contended that the case was premature since no devices had launched and marketing had not been fully active. However, the court rejected this argument, stating that under U.S. trademark law, publicity alone can constitute trademark use. Consequently, OpenAI and its partners are barred from using the “io” name for the disputed hardware and must refrain from any marketing or branding that could violate the injunction. Promotional pages and videos announcing the venture have already been removed from websites and social media.
